Article 2 (Purchase)

  1. In this service, the purchase applicant agrees to this agreement, wishes to purchase by the method specified by KomachiShoten, and KomachiShoten approves this, and the purchase shall be completed.

  2. The purchase applicant is fully responsible for any related tax duties when purchasing goods.

  3. KomachiShoten may not approve the purchase request if it determines that the purchase applicant falls under the following criteria, and shall not be obliged to disclose the reason for such non-approval.

  • When the purchase applicant reports false matters when the purchase applicant wishes to purchase

  • Purchase from a person who has violated this agreement

  • In the case where the purchase applicant is a resident of Japan

Article 3 (Prices and payment method)

  • Those who wish to purchase shall pay the amount displayed on this website by the method specified by KomachiShoten. Credit card payments shall be made in accordance with the terms and conditions separately contracted with the credit card company. In addition, if any dispute arises between the customer and the credit card company in connection with the use of the credit card, the customer shall resolve it with the credit card company, and KomachiShoten shall not be liable.

Article 4 (Prohibited matters)

  8. The act of collecting or accumulating personal information, etc., regarding other purchase applicants

  9. Acts of using this service for improper purposes

  10. Acts that cause disadvantage, damage, or discomfort to other purchase applicants or other third parties of this service

  11. Acts of pretending to be another purchaser

  12. Promotion, advertising, solicitation, or business activities on this service not approved by KomachiShoten

  13. Acts of directly or indirectly benefiting antisocial forces in connection with KomachiShoten's services

  14. Other acts that KomachiShoten deems inappropriate

 

Article 5 (suspension of provision of this service, etc.)

  • KomachiShoten may suspend or suspend the provision of all or part of this service without notifying the purchase applicant in advance if it determines that there is any of the following reasons.

  1. When the computer system is being updated or maintenance related to this service

  2. When there is website maintenance related to this service

  3. When it becomes difficult to provide this service due to force majeure such as a pandemic, earthquakes, lightning strikes, fires, power outages or naturally caused disasters.

  4. When computer or communication connections stop due to an accident

  • KomachiShoten shall not be liable for any disadvantage or damage suffered by the purchase applicant or a third party due to the suspension or interruption of the provision of this service.

 

Article 6 (Usage restrictions)

  • KomachiShoten will restrict the use of all or part of this service to the purchase applicant without prior notice if the purchase applicant falls under any of the following. If the purchase applicant violates any provision of this agreement

  1. When it turns out that there is a false fact in the purchase.

  2. When it is found or suspected that the purchase is for an act that infringes a trademark right or other intellectual property rights.

  3. If there is no response to the contact request from KomachiShoten for a certain period of time

  4. In addition, when KomachiShoten determines that the use of this service is not appropriate

 

  • KomachiShoten shall not be liable for any damages caused to the purchase applicant due to the actions taken by KomachiShoten based on this article.

Article 7 (Notification or Contact)

  • Notification or communication between the purchase applicant and KomachiShoten shall be made by the method specified by KomachiShoten. The contact registered by the purchase applicant at the time of ordering is considered to be valid and the contact is notified or contacted, and these notifications or contacts are deemed to have reached the purchase applicant at the time of transmission.

 

Article 8 (Delivery)

  • KomachiShoten considers that the address specified by the purchase applicant at the time of ordering is valid, and carries out the shipping procedure of the goods, and uses the shipping method specified by KomachiShoten.

 

Article 9 (Refunds, exchange and free maintenance)

  • The conditions set forth below shall apply to the return or exchange of goods. The purchaser shall bear the shipping charges for the returned goods. If a refund or exchange is applicable, after KomachiShoten receives the goods to which the following refund or exchange applies, the purchaser will be refunded or exchanged for the total amount paid (customs, taxes and any purchase-related fees are exclusive) by the purchaser.

Article 10 (Denial of Warranty and Disclaimer)

  1. KomachiShoten does not take any responsibility for any damage caused to the purchase applicant due to this service. However, if the contract between KomachiShoten and the applicant for this service (including this agreement) is a consumer contract stipulated in the Consumer Contract Law, this disclaimer does not apply.

  2. Even in the case stipulated in the proviso of the preceding paragraph, KomachiShoten shall not be liable for any damage caused by extraordinary circumstances to a prospective purchaser due to a default or illegal act caused by KomachiShoten's negligence (excluding gross negligence). KomachiShoten shall not be liable for any loss or damage (including cases where KomachiShoten or the prospective purchaser foresaw or could have foreseen such loss or damage).

  3. KomachiShoten is not responsible for any transactions, communications, disputes, etc., that occur between the purchase applicant and other purchase applicants or third parties regarding this service.

  4. KomachiShoten will not be liable for any damages related to this service if the receipt is delayed due to the convenience of the shipping company or customs procedures.

Article 11 (Changes in service content, etc.)

  • KomachiShoten may change the contents of this service without notifying the purchase applicant, and shall not be liable for any damage caused to the purchase applicant due to this.

Article 12 (Change of Terms of Use)

  • KomachiShoten may change this agreement at any time without notifying the purchase applicant if it deems it necessary. If the purchase applicant starts using this service after changing this agreement, the purchase applicant will be deemed to have agreed to the changed agreement.

Article 13 (Handling of personal information)

  1. In interpreting this agreement, Japanese law shall be the governing law.

  2. In the event of a dispute regarding this service, the court having jurisdiction over the location of KomachiShoten shall be the exclusive jurisdiction.
